LEASE
This
Agreement is made between the Drift Inn
Cottage Owner, the LESSOR, and Your Name
Here, of Anywhere, NY, the
LESSEE.
1.
Description of Property, Lease Term, and
Occupancy.
Lessor
agrees to lease to Lessee the property
known as "Drift Inn Cottage", 698 Port
Clyde Road, Port Clyde ME. The lease term
shall begin at 4:00 pm on Saturday
[insert date], and will end at
10:00 am on Saturday, [insert
date]. The number of persons occupying
the premises under this lease is
[insert number not to exceed 6].
Should a group exceed the maximum number
of people (as stated), they may be
required to vacate the property without
refund.
2.
Keys.
Keys to
the premises will be available at 4:00 pm
the day the lease term begins (unless
prior arrangements have been made) at
[address to be supplied]. All
rental and security deposit payments must
be received by Lessor prior to turnover of
keys. A $25 lost key charge will be
deducted from Lessee's security deposit
for each key not returned to Lessor on the
final date of the lease period and/or cost
of replacement locks if deemed necessary
by Lessor.
3.
Rent.
If lodging
tax is not charged, Lessee represents and
warrants that the rental period is for
more than 28 consecutive days and that the
leased premises are Lessee's primary
residence or that the leased premises are
occupied for either educational or
employment related purposes.
Total rent
for the period is [insert total @
$2000 per week].
The
payment schedule shall be as follows: 50%
to be received by Lessor at the signing of
this lease by Lessee and within seven days
of telephone reservation; balance to be
received by Lessor at least thirty days
prior to the start of lease term. In
addition, a security deposit of $1,000.00
shall be deposited with Lessor at least
thirty days prior to start of lease term.
All checks should be made payable to
Lessor, and mailed to [insert
address].
Reservations
made less than 30 days prior to arrival
require full payment made via cashier
check, certified check mailed overnight to
Lessor or wire transferred
funds.
4. Return
of Security Deposit.
Within
thirty days of the end of the lease term,
Lessor shall return security deposit in
full, or provide Lessee with written
notice of any charges (such as telephone
calls, lost key charges, late departure
penalty fee, charges for lost or broken
property or for other damage caused by and
attributable to Lessee or Lesee's guests,
and the cost of extraordinary cleaning at
premises) and return the balance, if any,
of the security deposit to
Lessee.
5. Breach
of Lease.
In the
event Lessee defaults by failing to pay
all payments required under paragraph #3,
or permits occupancy by more than
permitted number of persons, or violates
obligations set forth in Lessee's
obligations in paragraph #8, then Lessee
shall forfeit all monies paid.
6.
Cancellations. (All cancellations must be
made in writing.)
In the
event Lessee cancels prior to 30 days of
occupancy and after a reservation deposit
has been made, such deposit shall be
forfeited unless the premises can be
re-rented for the same time period and at
the same rate by Lessor, then Lessee's
deposit shall be returned minus a 25
percent cancellation fee. If cancellation
is made within 30 days of occupancy, full
rental monies will be
forfeited.
